Accuracy and Contract
The information given herewith is an invitation to treat, not an offer of sale and is given in good faith. If there is any additional information you require, these can be given at the time of sale.
The information given is not intended to form the basis of any contract. Contracts can only be made by viewing the vehicle, completing and signing an order form and paying a deposit.
Any contract made with us is subject to our Standard Terms of Business. Copies are available and appear on all of our order forms and invoices.
Any mileages quoted are approximate and may not be guaranteed - please confirm before you purchase.
Every effort is made to ensure vehicle specifications are correct, descriptions may from time to time contain inaccuracies and or errors and we expressly exclude liability for any such errors to the fullest extent permitted by law.
Severability
If any of these terms and conditions become or are declared to be illegal or otherwise unenforceable by any Court of competent jurisdiction such terms shall be deemed deleted (to the extent necessary) and all remaining terms shall remain in full force and effect.
Deposits and balance Payments
Deposits can be made by Bank Transfer, Debit card, Credit card or cash. A credit card can only be used up to the value of £1000.
Balance payments for vehicles can be made via Bank transfer, Debit card, finance payments and cash. A maximum of £9000 cash can be taken at any one time as payment towards a vehicle purchase. This is to comply with UK Money Laundering regulations.
Vehicle purchases and Part Exchange
An appraisal is under taken on every vehicle bought into the company as a Part Exchange or outright purchase. This is to ascertain a valuation for the vehicle. The valuation is subject to change if the vehicle condition or specification differs from the appraisal upon delivery to The Superbikes.
All vehicle documentation must be supplied by the seller. This includes V5c, Valid MOT, Service history, All keys, Handbooks
If the vehicle is subject to a cherish transfer or retention a £500 holding deposit will be taken from the customer. This will be refunded upon completion of the cherish transfer or retention and once the new V5c displaying the updated vehicle Registration number has been received by The Superbikes.
Distance Selling
Where a sale has been agreed away from our business premises and/or without any face to face contact between us and you; or anyone acting on your or our respective behalf, you may give notice to cancel this Agreement within 14 days without giving any reason.
This cancellation period will expire 14 days after the day on which you, or a third party on your behalf, takes delivery or otherwise acquires physical possession of the vehicle. To exercise this right to cancel, you must inform us of your decision to cancel this Agreement in writing by clear statement to enquiries@thesuperbikes.com.
To meet the cancellation deadline, it is sufficient for you to send your communication confirming your exercise of the right to cancel before the cancellation period has expired.
If you cancel this Agreement, we will reimburse to you all payments received from you under this Agreement, without undue delay, and not later than 14 days after the day on which we receive the vehicle back or if there were no Goods supplied, 14 days after the day on which we are informed about your decision to cancel this agreement.
We will make the reimbursement using the same means of payment as you have used for the initial transaction, unless you have expressly agreed otherwise, but in any event you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the vehicle back You should send back the vehicle without undue delay and in any event not later than 48 hours after you communicate your cancellation of this Agreement to us.
You are liable for any diminution of value of the vehicle resulting from the handling other than what is necessary to establish the characteristics and functionality of the vehicle. A mileage charge of 40p per mile will also be charged for every mile shown over and above the mileage on the vehicle at the time of delivery.
Finance
If you are selling a vehicle to us either as a direct sale or as a Part exchange, if you have any outstanding financial interest on the vehicle this must be disclosed to us before a contract is agreed. The said finance will be settled by The Superbikes upon receipt of the vehicle and associated settlement documentation.
Data Protection
We will keep your information secure and will never share it with anyone except if required to do so by law or on the request of the police, your finance company, WMS, our legal representative, local authorities, the DVLA or HMRC and only where they have legitimate reasons for gathering the data. Any further sharing of your personal information will only be permitted if you expressively request us to do so, in writing.
If you are taking out finance with your vehicle purchase the information you have provided for the finance proposal will be disclosed to lenders for the purposes of considering your credit application. Lenders may use this information to carry out searches with credit reference agencies. A record of those searches will be kept and may be used by other lenders in accessing applications from you and members of your household for credit in the future. Lenders will cross check this information with other lenders to help prevent fraud.

By entering and using our websites you agree to both comply and be bound by our terms and conditions including our privacy policy. This policy will govern the relationship between The Superbikes and yourself

The websites and the content is owned and or licensed by us. This is not limited to but may include, design, content, look and appearance.
No reproduction is permitted and if a breach of this is found then this may give rise to a claim for damages and or a criminal offence.
The websites from time to time may promote third parties and or their services in which case The Superbikes will not be held responsible for third party links and or its content.
The use of the websites and any dispute arising out of such use of the websites is subject to the laws of the UK for the time being in force.
By using the websites, you consent to your agreement to the stated terms and conditions which may change without notice.
Complaints
In the event of a complaint or dispute the issue must first be logged by post or email for the attention of the general manager at The Superbikes. The complaint should be directed as follows.
If your complaint cannot be resolved after you have exhausted our internal process, the complaint will then be referred to the ADR group. www.adrgroup.co.uk/
